A BILL to amend and reenact section twenty, article one, chapter
ten of the code of West Virginia, one thousand nine hundred
thirty-one, as amended, relating to the giving of aid to
libraries by the library commission; and providing for the
manner of distribution of funds appropriated to the library
commission for aid to libraries.
Be it enacted by the Legislature of West Virginia:
That section twenty, article one, chapter ten of the code of
West Virginia, one thousand nine hundred thirty-one, as amended,
be amended and reenacted to read as follows:
ARTICLE 1. PUBLIC LIBRARIES.
§10-1-20. Aid to libraries by library commission.
The West Virginia library commission is hereby authorized and empowered to render such that aid and assistance, financial,
advisory and/or otherwise, to public, school, county or regional
libraries, whether established or maintained by said the library
commission or not, under such conditions and rules and
regulations as the said commission deems necessary as provided in
this section, to further the interests of the state and best
increase the efficiency of the service it is expected to render
the public.
Having determined that the development and support of such
libraries will further the education of the people of the state
as a whole and will thereby aid in the discharge of the
responsibility of the state to encourage and foster education,
the West Virginia library commission is authorized and empowered
to pay over and contribute to county commissions and to any board
of library directors created and maintained pursuant to the
provisions of this article or any special act of the Legislature
such the sum or sums of money as may be available from funds
included in appropriations made for the West Virginia library
commission for such that purpose. The amount of any such payment
or contribution by the commission to any such local library board
of directors shall be determined in accordance with rules and regulations promulgated by the commission and consistent with the
requirements of this section. The library commission shall have
authority to promulgate rules and regulations governing the
manner of accounting for expenditures of the moneys appropriated
and distributed in accordance with this section.

amount or amounts of money shall be accounted for and expended.

One third of the moneys appropriated shall be divided and
distributed equally among the fifty-five counties of the state
and shall be paid over to the county commissions of each of the
fifty-five counties. Each county commission shall distribute all
of the moneys to all of the libraries situate in the county in
that manner and in that proportion among the libraries in the
county as the county commission considers appropriate.
The remaining two-thirds of the moneys appropriated shall be
distributed by the library commission to all of the boards of
library directors created and maintained pursuant to the
provisions of this article or any special act of the Legislature
on a per capita basis of the number of persons who are served by
each library.
NOTE: The purpose of this bill is to provide for the
manner of distribution of moneys appropriated to the library
commission for aid to libraries. One third is to be distributed equally between the fifty-five county commissions who shall
distribute the moneys to libraries in their county at their
discretion, and the remaining two-thirds is to be distributed by
the library commission among all libraries on a per capita basis.
